Terms and Conditions of Sale – Neonail UK
Effective from: 15 October 2025
1. Definitions
“Seller”, “we”, “us”, “our”: Neonail UK (www.neonailuk.com).
“Buyer”, “you”, “your”: The individual or entity purchasing Goods from us.
“Consumer”: A Buyer acting wholly or mainly for purposes outside their trade, business, craft, or profession.
“Business Buyer”: A Buyer purchasing Goods wholly or mainly for business, trade, or resale purposes.
“Goods”: Any products offered for sale on our website, including but not limited to UV/LED polishes, nail care items, and related accessories.
“Contract”: The legally binding agreement between you and us for the sale and purchase of Goods.
2. Applicability of Rights
The rights and remedies set out in Clauses 3–7 of these Terms apply only where you are contracting as a Consumer. Where you are contracting as a Business Buyer, Clauses 8–9 apply, and you acknowledge that you are not entitled to rely upon the statutory consumer protections set out in the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 or the Consumer Rights Act 2015.
3. Consumer’s Right to Cancel (Cooling-Off Period)
3.1 If you are a consumer, you have a legal right to cancel your order for most Goods within 14 days without giving any reason. This right begins on the day after you (or someone you nominate) receive the Goods.
3.2 To exercise your right to cancel, you must inform us of your decision to cancel by a clear statement (for example, by email or using our cancellation form, if available).
3.3 To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the 14-day cancellation period has expired.
3.4 You must send the Goods back to us without undue delay and in any event not later than 14 days from the day on which you inform us of your cancellation. You are responsible for the direct cost of returning the Goods unless they are faulty, damaged, or misdescribed (see Clause 5).
3.5 You are liable for any diminished value of the Goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.
3.6 If you purchase digital content (for example, e-books or downloads), your right to cancel will end once the download or streaming has begun with your express consent and acknowledgement that you lose the right to cancel once performance begins.
4. Refunds Following Cancellation (Consumers Only)
4.1 Where you validly cancel your order under Clause 3, we will reimburse you:
(a) the purchase price of the Goods; and
(b) the cost of standard outbound delivery (being the least expensive delivery option offered at checkout).
4.2 We are not required to refund any supplementary delivery costs where you selected a non-standard service (for example, next-day or premium delivery).
4.3 We may withhold reimbursement until we have received the Goods back, or you have supplied evidence of having sent the Goods back (whichever is earliest).
4.4 We will make the reimbursement using the same means of payment you used for the initial transaction, unless you have expressly agreed otherwise. No fees will be charged for the refund.
4.5 Refunds will normally be processed in accordance with the Returns Procedure at Clause 7.
5. Goods That Are Faulty or Not as Described (Consumers Only)
5.1 Consumers have statutory rights under the Consumer Rights Act 2015 if Goods are defective, misdescribed, or not fit for purpose. Nothing in these Terms affects those rights.
5.2 Where Goods are faulty within thirty (30) days of delivery, you are entitled to a full refund, and we will bear the reasonable cost of return postage.
5.3 If a fault arises after thirty (30) days but within a reasonable period, you may be entitled to a repair or replacement (or, if this is not possible, a refund). We will bear the reasonable return costs in such cases.
5.4 Where Goods are materially different from their description or images on our website, you may be entitled to a refund and reimbursement of return costs.
5.5 Minor variations in shade, colour, finish, or texture — including those attributable to display settings, lighting, or normal manufacturing tolerances — shall not constitute a defect or misdescription and will not entitle you to a refund or exchange beyond your statutory right to cancel (see Clause 3).
6. Representation of Goods
We take reasonable care to ensure that product descriptions, specifications, and images are accurate and up to date.
However, due to differences in individual display settings, lighting conditions, and screen calibrations, colours and appearances may vary slightly from how they appear on your device.
Such minor discrepancies shall not entitle you to reject the Goods or claim that they are faulty or misdescribed.
6A. Colour and Appearance Disclaimer
We make every effort to ensure that the colours and finishes of our products are represented accurately online.
However, variations may occur between batches, and differences in screen display settings, lighting, or device technology may cause perceived differences in colour.
Accordingly, slight variations between the product images on our website and the Goods received shall not be regarded as faults, defects, or misdescriptions under consumer law.
Only material or substantial differences (for example, if a product described as “navy blue” is supplied in a clearly different colour such as green) will be treated as “not as described” for the purposes of the Consumer Rights Act 2015.
7. Returns Procedure
7.1 Before returning any Goods, you must obtain a returns authorisation from our customer service team and provide your order number, details of the Goods being returned, and the reason for return. Please contact customer.service@neonailuk.com
7.2 Goods must be returned in their original condition and, where practicable, in their original packaging.
7.3 We recommend using a tracked delivery method and retaining proof of posting, as we cannot accept liability for Goods lost in transit.
7.4 Refunds will be processed within fourteen (14) days of our receipt of the returned Goods or evidence of return, provided they meet the conditions set out in Clauses 3–5.
8. Business Buyer Terms (B2B)
Where Goods are purchased by a Business Buyer, the provisions of Clauses 3–7 do not apply. All sales to Business Buyers are final, and no right of cancellation or return shall apply unless expressly agreed in writing. Any warranties, conditions, or other terms implied by statute or common law are excluded to the fullest extent permitted by law. We shall not be liable to Business Buyers for indirect, consequential, or economic losses, including (without limitation) loss of profit, revenue, goodwill, or business opportunities.
9. Limitation of Liability (B2B)
Our total liability to a Business Buyer in respect of all losses arising under or in connection with the Contract (whether in contract, tort, or otherwise) shall not exceed the price paid for the Goods giving rise to the claim. Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
10. Governing Law and Jurisdiction
These Terms and Conditions and any dispute or claim (including non-contractual disputes) shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction in respect of any dispute or claim.
